3 signs your partner is struggling to consent to the prenup

Ideally, a prenup protects both parties and fosters transparency. But for many, the conversation around a prenup can bring up deep-seated fears, insecurities or a sense of imbalance.

While a partner may sign the document, that doesn’t necessarily mean they were fully on board emotionally or mentally. Recognizing the signs that your partner is struggling to give enthusiastic consent to the prenup is crucial for the health of your relationship.

1. They avoid the conversation or change the subject

If they frequently deflect questions about it or change the subject whenever it’s brought up, this can signal internal resistance. They may not know how to articulate their discomfort or may be afraid of conflict. In some cases, the prenup may feel one-sided or unnecessary to them, and instead of voicing that directly, they retreat emotionally.

2. They sign without asking questions or expressing opinions

A partner who agrees too quickly or without reviewing the document thoroughly may be doing so out of pressure, resignation or a desire to keep the peace. True consent involves informed decision-making. You should be worried if your partner hasn’t:

  • Asked about specific clauses
  • Sought independent legal guidance
  • Offered feedback on how to make the agreement more mutual

In some cases, this can create long-term resentment or feelings of disempowerment.

3. Their behavior changes after signing

Watch for shifts in your partner’s demeanor after the prenup is signed. Do they seem distant, frustrated or less affectionate? Have they started making sarcastic or passive-aggressive comments about money or fairness? These are often signs that they’re emotionally processing unresolved feelings. A prenup can stir up fears about being undervalued or unprotected in the relationship.

If your partner is struggling to consent to the prenup, it’s not just a legal issue but a relational one. Taking the time to revisit the conversation, enlist insightful legal guidance and reaffirm the emotional safety within your partnership can transform the prenup process from a point of tension into an opportunity for growth and clarity.
